PLEASE READ THESE CAREFULLY. BY ACCEPTING A COMMISSION FROM ME YOU AUTOMATICALLY ACCEPT THESE TERMS AND CONDITIONS.

GENERAL

I reserve the right to decline any commission request.
I reserve the right to adjust the price of any commission accordingly. However, I will never change the price of a commission that has already been previously agreed upon.
All personal information and details provided by the client with be kept private and confidential.
All artwork made by the artist is copyrighted under BoochkinBoo / SenpaiBeth / SenpaiStudio LTD

Payment will be through my PayPal in GBP only
I require to be paid fully upfront OR half upfront (unless stated otherwise in our communication), before I add your commission to my queue & then start working on it.
Upon completion, then I'll email/DM you the files from your project.
Only file sizes needed & agreed on will be sent, no source files. (unless specified & agreed on upon commission)
Revisions will only be accepted during the sketch phase. - adequate minor revisions and/or 2 major revisions. Any revisions made after the commission has been finalised will result in a further payment of 50% of the original agreed price being added on. Payment for additional revisions are required before I start revising.
Complexity of the design might result in additional charges to your commission - e.g. number of characters, time needed, etc.
CLEAR reference images or detailed descriptions are required. If you provide blurry images or a brief description and are then not happy with the result then that is on you, not me. I go off what I am given and what I can understand from your references.
It is a first pay, first serve basis. If you want priority over other commissions with will result in further charges to your commission.

IMAGE RIGHTS AND USAGE

I reserve full right to the image and its distribution and use, unless otherwise specified.
I reserve the right to display any commissioned image(s) on my website or my portfolio.
The commissioner can not claim the work as theirs (e.g. ‘I made this’, ‘I created this’, etc).
The commissioner can not use my image for commercial/profit purposes, unless specifically commissioned for that purpose or the commissioner is given permission at a later date upon request (*see items listed below). The commissioner MUST get permission to use artwork for commercial/profit purposes, even if you commissioned the piece for a seperate commercial/profit purpose and want to use it for another purpose (e.g. Using a twitch emote as merch). The commissioner must always ask permission to use non-commercial commissions, such as icons, as commercial/profit purposes before uploading or submitting any artwork to use commercially.

*Specific commissions that allow commercial/profit purposes:
- Twitch Emotes
- Merch Designs (E.G. Posters, t-shirt designs, mugs, etc...)

It is advised and enforced that the commissioner states that he/she intends to use the commissioned artwork for commercial/profit purposes whilst details of the commission are being discussed and before payment is received from the commissioner.

Failing to have permission in using my artwork for commercial/profit purposes will result in a report against your product with efforts to also take the product down from selling any more purchases until permission is granted.

The commissioner is allowed to upload commissions on social media sites, as long as the commissioner does not claim the artwork to be created by themselves and the commissioner gives credit somewhere on the post, or in a reply to the post.
Credit to the artist is always required when posting or when using the commissions on online platforms, such as using twitch emotes or graphics. (Example credits: Emotes created by @SenpaiBeth, artwork created by @SenpaiBeth)

I retain full rights to my artwork, unless otherwise specified and agreed upon via a mutually signed contract. You're allowed to use the finished commission for personal use & its intended use. (upload on Twitch, YouTube, Discord, social media etc. w/e we agreed on)
You're NOT allowed to edit the sketches or finished commission in any way shape or form, without my explicit knowledge & permission.
NO resizes, recolours, edits, animating, tracing to make new art, placing into other art.
You can NOT resell my artwork.
I will take legal action due to copyright infringement (e.g. DMCA) if the above rules aren’t followed, as the rightful owner of the copyrighted artwork.
If you want to make merchandise for a commissioned piece, or want to purchase the rights for it, please contact me to discuss details for the commercial and resale rights and their contracts.
You are NOT permitted, under any circumstances, to use any part of the finished commission for non fungible tokens (NFT's). Use of my artwork for any advertising or profits associated with non fungible tokens, blockchains, or cryptocurrency is strictly prohibited without my explicit knowledge & written permission.

THEFT

If any piece of the artist's artwork is found in the use of someone other than the commissioner or the artist, a copyright claim against the artwork will be taken, either with the website the artwork is posted on or directly to the user. I do not tolerate any usage of my artwork unless you are a client of the artwork being used or I have given direct written consent.
If it is found that the artist's artwork has been traced and posted elsewhere, for personal or financial gain, a copyright claim against the artwork will be taken, either with the website the artwork has been posted on or directly to the user.

PAYMENTS

All commissions are PayPal only. (Any currency is allowed as long as you adjust the price to match the conversion rates to £ when paying.) - Unless stated otherwise.

Payment will never be taken via bank transfers, shoutouts, exposure, or any other form of payment.

I reserve the rights to cancel and refund a commission at any time, with prior notice to the commissioner, due to poor communication, inappropriate behaviour, abuse from the commissioner, or in real life situations, personally, that render me unable to finish the commission.
You understand that I will NOT accept any refunds or accept any dispute of any payment already received.
Commissions are to be completed in the order that I receive payment, so first come first serve. (unless stated otherwise through communications)
Commission delivery times vary due to difficulty, real life situations, waiting list and other varying factors - an estimated time of delivery will be given upon commission request.

REFUNDS / CHARGEBACKS

No refunds or chargebacks. - Be 100% sure you want to commission me before payment is sent.
I will not refund a completed commission, especially after you’ve approved the submitted sketches for it.

Failing to comply with these terms will result in a future ban of commissioning artwork from me, and in some cases will result in a filed report (with evidence) to the correct persons against the commissioner.

If you have ever disputed against me on PayPal you will no longer be allowed to commission me in the future and shall be put on a blacklist.

By commissioning me (paying me), you automatically state that you have read and agreed to my terms of service.
